1. Service Description
NexCyberEU provides a B2B SaaS platform for EU regulatory compliance assessment of digital products. The platform includes deterministic compliance assessments (CRA, NIS2, AI Act, RED, DORA), obligation tracking, evidence management, SBOM tooling, and MRCC certificates.
2. Acceptable Use
- Use the platform only for lawful purposes in compliance with applicable EU and national law.
- Do not reverse-engineer, scrape, or extract the underlying regulatory rule engine.
- Do not use the platform to misrepresent or falsify regulatory compliance obligations.
- Do not share credentials or API keys outside your authorised organisation.
- Do not conduct automated bulk assessments exceeding plan limits without prior written agreement.
3. Payment, Credits and Subscriptions
- Free tier: Limited to 3 preliminary assessments per month. No credit card required.
- Paid plans: Billed monthly or annually via Stripe. Fees are non-refundable except where required by law.
- Credits: Each full assessment deducts 1 credit. Unused credits expire 12 months after purchase.
- Renewals: Subscriptions renew automatically. Cancellation takes effect at end of current billing period.
- Price changes: 30 days notice provided before any pricing changes.

NexCyberEU provides regulatory intelligence tooling, not legal advice. Assessment outputs do not constitute legal opinions and should not replace qualified legal counsel. You retain sole responsibility for your regulatory compliance posture.
5. Limitation of Liability
- Total aggregate liability shall not exceed fees paid by you in the 12 months preceding the claim.
- We are not liable for indirect, consequential, or punitive damages including loss of profits or regulatory fines.
- We are not liable for reliance on assessment outputs in regulatory submissions or legal proceedings.
6. Intellectual Property
All platform software, rule sets, MRCC schemas, and documentation are the exclusive intellectual property of NexCyberEU. Your subscription grants limited, non-exclusive access during the subscription term. Assessment outputs generated from your product data are owned by you.
7. Governing Law and Jurisdiction
These Terms are governed by French law. Disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
